Terms of service
Last updated: October 6, 2026
These are the conditions for using Vitolarium. They are written in plain language, not legal jargon, and they describe what actually happens.
What Vitolarium is
An app for keeping track of a personal humidor: which cigars you own, where they are, what you paid for them and what you thought of them. Nothing beyond that.
It does not sell tobacco or offer it for sale. It is not a shop, not a club and not a social network. There is no forum, no messaging between users and no public posting.
Who can use it
People over 21. Anyone can create an account, with a confirmed email address or with their Google account.
Each account belongs to one person. You are responsible for your password and for what is done from your account. If you suspect someone got in, change it and tell us. We recommend turning on two-step verification.
What you enter is yours
The content you upload — your purchases, your tastings, your notes, your photos — remains yours. We claim no ownership over it. We store it and show it back to you, and that is the whole of the licence we need.
The catalogue of brands and cigars is different: it is shared reference information across the platform and belongs to no account.
Independence
Vitolarium does not receive payments, products, samples or any other benefit from manufacturers, distributors, importers or retailers of tobacco products in exchange for showing, featuring, ordering, recommending or rating products or brands. The catalogue is informational: it identifies products so that each person can manage their own collection, and its order and content do not depend on any commercial agreement.
Vitolarium may receive corrections from those companies to the data on their own products; they are reviewed like any other source, are not paid for and carry no distinction of any kind. It may also sell them aggregated, anonymous statistical information, with no data that could identify any person and only from users who have agreed to it.
Acceptable use
By using Vitolarium you agree not to:
- Use it to sell, promote or offer tobacco.
- Upload content that is unlawful, belongs to someone else without permission, or that you have no right to upload.
- Attempt to view, modify or delete another account’s data, or look for ways around the access controls.
- Automate use in ways that degrade the service for others, or attempt to bring it down.
- Share your account with anyone under 21.
Availability, said plainly
The service is provided as is. We do not promise it will always be available, nor that it will be free of errors, nor that information cannot be lost.
And there is a concrete reason to put it that bluntly: Vitolarium runs on third-party free plans. If any of those services changes its terms, fails, or suspends the account, the app may stop working without notice.
So: export what matters to you. Reports download in several formats and that copy is yours, independent of us.
Payments, subscriptions and refunds
Today Vitolarium charges nothing. The paid plans are not available yet (they are shown as “Coming soon”) and no payment method is enabled. Before we start charging we will tell you by email, and you will never be charged anything without explicitly agreeing to it.
Once charging begins, the following applies:
- Before you pay you will see the final price of the plan, taxes included. Anything your bank or card adds on its own account (such as tax withholdings) is not part of that price.
- Amounts paid are non-refundable, except for the legal right of withdrawal explained below.
- If you cancel an annual subscription before the year is up, what you paid is not refunded, but you can reactivate it at no cost at any time within that same year.
- If you cancel or move to a smaller plan, nothing you entered is deleted: whatever exceeds the new plan stays available to view, but not to add to.
- If you buy a plan through Google Play or the App Store, the store handles the payment and its refund policy also applies.
The right of withdrawal is yours by law, cannot be waived and nothing in these terms limits it:
- In Argentina, you can withdraw within 10 calendar days of signing up, without giving a reason and at no cost, and what you paid is refunded (Law 24,240, art. 34, and Resolution 424/2020). Once charging begins you will be able to do so with a clearly visible withdrawal button, or by writing to us.
- In Paraguay, you also have 10 calendar days from signing up to withdraw, without giving a reason and at no cost, and what you paid is refunded. This is the right of withdrawal under Law 1334 on Consumer and User Protection (art. 26): if that law gives you more, the law applies. Once charging begins you will be able to do so with the same withdrawal button, or by writing to us.
- In any other country, the rights its consumer protection law gives you apply.
Closing the account
You can close your account whenever you want, and ask for everything of yours to be deleted. It gets deleted.
We may suspend or close an account that breaks these terms, or that puts the service or other people’s data at risk. Except in serious cases, we give notice first.
Liability
Vitolarium is a personal record, not an accounting system, not a tax inventory and not investment advice. The valuations it shows come from the prices you entered and are not an appraisal. To the extent the law allows, we are not liable for losses arising from use of the service, from its unavailability, or from loss of data.
Privacy
What data we store and who can see it is in the privacy policy, which forms part of these terms. Privacy
Changes to these terms
If this changes, the date above changes. If the change genuinely affects you, we will tell you by email before it takes effect.
